But Football Association of Zambia (FAZ) vice-president Emmanuel Munaile said Mayuka was duly cleared to join the Israeli club.
In an interview yesterday, Sandamuka said Warriors was not party to the contract which Mayuka signed with the Israeli club.
Sandamuka said Warriors had entered negotiations with stakeholders, including FAZ, on Mayuka’s move to Israel.
“Yes, Mayuka has signed some contract but we are not party to that contract. As far as we are concerned, we are still discussing as clubs Warriors and Maccabi,” he explained.
Asked if Mayuka was still a Warriors player, Sandamuka responded; “He is… oh yes, he is still our player.”
But Munaile said FAZ issued an International Transfer Certificate (ITC) for Mayuka because the player had committed himself to the Israeli club.
Munaile said according to the FIFA statutes, Mayuka was a minor and required parental consent to validate his professional transfer.
Munaile, who is also FAZ spokesperson, said Mayuka’s mother gave consent to the player’s decision.
“The player committed himself and the mother gave consent… when it came to our attention, we looked at those factors,” he said.
Munaile said FAZ issued the ITC based on Mayuka’s decision to commit himself to the Israeli club.
When asked on why a copy of Mayuka’s contract didn’t include an official signature from Warriors, Munaile said; “Warriors must know. We gave an ITC because Mayuka had committed himself to Maccabi. In the past, we have had cases where players sign with this club and they come and sign with another club.”
According to a copy of Mayuka’s contract entered on September 24, 2008 and obtained by The Post yesterday, Warriors is the sole owner of the player.
“Whereas: Kabwe Warriors is the sole owner of any and all of the economic and federative rights of the player Mr. Emmanuel Mayuka, bearer of Zambian Passport no. ZM 073018 (the “Rights” and “Player”, respectively); And Whereas: the Parties held negotiations regarding the selling of the Rights to Maccabi;” reads part of the contract.
“NOW, THEREFORE, in consideration of the mutual premises, covenants and other agreements contained herein, the parties hereby agree as follows:”
The contract states that Warriors had sold Mayuka for US $50, 000.
“2. The consideration will be paid to Kabwe Warriors as follows: 2.1 A sum of US $30, 000 (Thirty thousand US Dollars) no later than 30 days from the date the Israeli Football Association received the ITC of the Player in favor of Maccabi,” another part of the contract states. “2.2. A sum of US $20, 000 (Twenty thousand US Dollars) no later than March 1st 2009.”
The contract indicates that Maccabi would pay Warriors 20 per cent of any transfer fees deriving from the first transfer of the player to a third club.
The contract further gives instructions of the transactions but does not provide the Warriors bank details to which the transfer would be submitted.
However, the 10-clause contract is only undersigned by Maccabi representatives with the space meant for Warriors left blank.
Another part of the contract reveals two letters issued and signed by Mayuka’s mother Freedah Chungu on July 30, 2008.
The letter of authorisation by Chungu dated July 30, 2008 with a stamp indicating ‘Republic of Zambia special assistant to the President legal affairs’ witnessed by a D. Mwape gives Nir exclusive rights to negotiate a contract for Mayuka.
Another letter addressed to the Israeli visa section, copied to Maccabi and Nir with a similar date stamp and witness serves as supporting document for Mayuka’s visa application.
A 12-page attachment to the contract entitled Annex to Players Agreement Form is signed by Mayuka on all the pages with a letter of waiver of medical confidentiality granted by Dulee Johnson, a Liberia of passport number ZC 099193.
Sources revealed that Warriors and FAZ officials are today expected to have a meeting over Mayuka’s transfer to Israel.
Meanwhile, Nir on Sunday confirmed in a telephone that Mayuka had signed a three-year deal with Maccabi Tel Aviv.
Nir said Mayuka featured for Maccabi youth side on Saturday and scored a goal.
He said the player would spend the first season in the youth league before graduating to the senior team.
Nir is confident Mayuka will succeed at the Israeli side.

It is difficulty for clubs to develope if they have little say on their own players. Clubs should also not be rigid when it comes to transfers to avoid players falling prey to fake agents.
The Mayuka saga is partly Warriors own making, Porto came to them first but they rubbished the $ 50 000 initial offer without recourse for bargaining. It is unfortunate that the Isreal side has signed Mayuka for the same $50 000 (with stagered payement dates)warriors had rejected from Porto. Now Porto are back with a better offer I pity warriors but they have got to work up you can not hold a player at ransom football is a short career they lad might have acted under desperation to turn pro after warriors had refused to listen to his plea of wanting to play for porto.
To FAZ, shouldn`t our local clubs be consulted before a clerance certificate is issued for a player. The clearance certificate given to Mayuka and Kombe have been under very suspicious circumstances. Keeping eyes on the ball requires that all things surrounding the ball are taken care of players clearence included!

how can a player be cleared without the clubs consent. these complications which surround our players before they go to europe will start affecting the perceptions of buyers in future. for our friends in other AFRICAN countries things seem to be moving easily. the problem is this nidwelepo atitude is killing us.

Firstly Vincent, Porto came with a $10,000 offer not $ 50,000 which I still think is still a joker amount. All these clubs, the Iisreal side included are really working off our ususal urgency to get players playing internationaly and as such get our players for peanuts.
So Munaile and Co. found it fit to issue an ITC without the clubs consent. Did an around the block move and got his mother to give consent and quickly issue an ITC on this strength. If FAZ, the highest football controlling body in the country finds it fit to work like this someone please tell me, WERE IS OUR SOCCER HEADING TO!!!!!!
Thats why players like Kombe can leave and ask for clearance directly from FAZ without firstly finalising things at club level. Even the playeers know that there are jockers at FAZ who will play around the block moves and skip the club. Imagine if the Premeirship had people of Munailes reasoning running the show big clubs like Mmanu would have lost Ronaldo to Madrid without having a say. Its amaizing how jockers get to run things. You siit on your a____ and justify issueing an ITC based on a mothers consent. No disrespect but what concrete knowledge would she have about these sort of contracts.

Sir Big Steve the comparison of Mmau to mayuka issue is not compatible.Zambia players, especially at kabwe are not on written contracts, so very vulnerable to this type of moves.Since FAZ sent the ITC and Mayuka himself signed, KWFC should just let go the young boy.
patience pays, kabwe should have waited to complete the porto negotiations, if any were there b4 sending off emma to israel.

I don’t understand why the club was not consulted over Mayuka. There could be a Nichekeleko issue here or maybe i am missing something.I smell a rat here.It looks like both Faz & Warriors “boobed”.

Munee not to get academic but written or verbal agreement forms contract. The player under some sort of agreement plays for or played for Warriors as such is or was under contract.
There is simply no justification to totally disregard the clubs opinion on the matter based on the fact that there is no signature and yet the player drew salary from this very club signifying agreement to give service in the capacity of football player.
Like Sibs I smell a rat, most definitely there is Nichekeleko issues going on here. rush to get a two letter signature from his mother C’MON!!!!!!!!!

Munee, even players in Zambia have contracts binding them to their clubs.
I think FAZ should be above board and show maturity and guidance in these issues. We cant have our clubs being duped when it comes to player transfers with the mother body FAZ being actively involved.
Unless thers something am not understanding here, but we can not have two players in this short period of time going away without club consent yet sanctioned by FAZ. I guess whoever is handling transfers at FAZ at the moment is incompetent.
FAZ, lets put an end to this and get our house in order.

It $ 10 000 dudes my apologies. Sibs & Steve at the end of the day we are all saying more or less the same thing , there is no sanity at the Football house for them to be issueing player clearance certificates without the consent of the clubs that have rights to these players.
Additionally though ,clubs have most of the time created room for these voultures at FAZ to cash in from the players transfers. I can`t agree more with you guys, in effect I don`t just smell a rat, but a big rat! Munaile par a disgusting to say the least.

I do not understand FAZ’s position here. It’s absolutely childish. They must know that in the end, they are supposed to check with all parties ie the buyer, seller, and player himself, or a representative in Mayuka’s case. How can they issue an ITC with some parties not having signed?
We shall have serious problems if this is the way things shall be run in football.

I think my blame goes to KW FC, who would like to hold on to the player for ever. Am glad that he has signed and KW Fc officials will sign belatedly, simple. Congrats Mayuka, even scoring on your debut. You will succeed no doubt about it.

Iyo Munee,I think your comment should be the guess of the week.You can’t say that we have nothing that binds our local players to their respective clubs.Why do FAZ ask clubs to register players at the begining of the year? & how is the process of local transfers together with the payments involved done if players don’t sign anything to comfirm the transfer?.Ive just noticed that the Mayuka & Kombe issues have happened at the same time & I suspect there must be some wrong guy at FAZ who is behind these inhand methods.If Kalu & Munaile are clean I expect them to investigate these issues & get to the bottom of this.Its a big joke to issue an ITC without the consent of the club selling the player.Infact in a normal situation its the selling club that is supposed to request for the ITC from FAZ or if it happens otherwise a normal person should pick up a phone or summon the club officials for comfirmation.Should we start saying that people are putting their eyes on the ball with sun glasses??.FAZ is not just about camping the national teams,these are the issues day to day & Kalu being the boss should be reminded that he is the one entrusted to manage our football affairs & he is expected to exercise control provide direction.The issue of not staying in Zambia is not our problem our main concern is order at FAZ &how he handles it is up to him.I can’t wait to see Kalu’s leadership skills on this saga

Going by what happend to the likes of the Mbesuma’s of this world, I think Mayuka is bettered served to start off and Maccabi an then move on to bigger clubs. He has a chance to easily break into the first team at Maccabi and that will only raise his stock. Warriors may not get a decent amount upfront but when he makes that million dollar transfer in a few months, they will be glad they waited. Lets put the player first and get him on his career tp greater heights. I had the chance of meeting this kid in Canada and I must say, he will be great

FAZ and Kabwe Warriors FC must resolve the issue amicably. Sandamuka and his club officials are in this for gain. They want to hold the player now that there is a big offer from Porto. Porto’s move may easily flop if Mayuka is not given the Maccabi chance. I think the wishes of the player should be respected.

here we go again! its the vultures at work behind the scenes, beyond what we see as fans.The mayuka & kombe case is nothing more than a few individuals that earn a living out of the talent of others, often times playing on their ignorance,desperation or even perhaps the inherent human greed e.g the christiano ronaldo saga.What we need however is a FAZ that is vigilant enough to follow laid down procedures to the letter.HATS OFF TO ESTHER PHIRI!
